Welcome to HerdIndex ("HerdIndex", "we", "our", or "us"). By accessing or using HerdIndex, you agree to these Terms & Conditions. If you do not agree, please do not use this website.
1. Purpose of HerdIndex
HerdIndex is an online directory and advertising platform designed to connect livestock buyers and sellers. HerdIndex does not own, inspect, evaluate, or sell any livestock listed on the website.
All transactions occur directly between buyers and sellers.
2. Accuracy of Information
The information displayed on HerdIndex is provided directly by breeders, consignors, breed associations, or other third parties.
While we strive to present information accurately, HerdIndex:
- Does not verify the accuracy or completeness of any listing.
- Does not guarantee the accuracy of pedigrees, EPDs, performance data, health information, registrations, photos, videos, descriptions, or any other information provided.
- Makes no warranties regarding the correctness or completeness of any listing.
Information may contain errors, omissions, or become outdated.
3. Buyer Responsibility
Buyers are solely responsible for conducting their own due diligence before purchasing livestock.
We strongly encourage all buyers to:
- Contact the breeder or seller directly.
- Ask questions regarding health, genetics, registrations, breeding history, and management.
- Verify all information important to their purchasing decision.
- Review registration papers and supporting documentation.
- Personally inspect the animal whenever possible, or arrange for a trusted third party to do so.
- Consult a veterinarian or livestock professional if desired.
Purchasing decisions should never rely solely on information displayed on HerdIndex.
4. No Endorsement
A listing on HerdIndex does not constitute an endorsement, recommendation, certification, or guarantee of:
- the breeder,
- the seller,
- the livestock,
- the genetics,
- or the information provided.
5. Limitation of Liability
To the fullest extent permitted by law, HerdIndex shall not be liable for any:
- direct,
- indirect,
- incidental,
- consequential,
- special,
- or punitive damages
arising from or related to:
- the purchase or sale of livestock;
- inaccurate or incomplete listing information;
- pedigree or EPD inaccuracies;
- health or fertility issues;
- registration disputes;
- misrepresentation by sellers;
- transportation issues;
- financial losses; or
- any dispute between buyers and sellers.
Use of HerdIndex is entirely at your own risk.
6. No Warranty
HerdIndex provides its website and listings on an "as is" and "as available" basis.
We make no warranties or representations regarding:
- availability of the website;
- uninterrupted access;
- accuracy of listings;
- suitability of livestock;
- merchantability;
- fitness for a particular purpose.
7. User Responsibility
Users agree not to knowingly submit:
- false information;
- misleading information;
- fraudulent listings;
- copyrighted material without permission;
- unlawful content.
Users are responsible for ensuring all information they submit is accurate to the best of their knowledge.
8. Changes to Listings
HerdIndex reserves the right to edit, remove, reject, or suspend listings at our discretion.
9. Intellectual Property
All HerdIndex branding, logos, website design, graphics, and original content remain the property of HerdIndex unless otherwise stated.
Listing information remains the property of the submitting breeder or owner.
10. Changes to These Terms
HerdIndex may update these Terms & Conditions at any time. Continued use of the website constitutes acceptance of any revised Terms.
11. Governing Law
These Terms & Conditions shall be governed by the laws of the Province of Saskatchewan and the laws of Canada applicable therein.
